Terms and Conditions

 

 

 

1. Scope

These terms and conditions include all activities of B-YOUnique (hereinafter referred to as the service provider), such as consultations, trainings, workshops, retreats, community events, etc. and / or unspecified contracts that are related to the business activities mentioned. This applies equally at home and abroad.

 

The service provider primarily provides fee-based services in the area of ​​advice, coaching (meditation & mindfulness, nutrition, massages & yoga). These General Terms and Conditions (GTC) apply to the purchase of any customer service that is obtained from the service provider in any way (by phone, email, website, social media, mobile, etc.). A customer is any natural or legal person who uses services that are provided by the service provider or who have registered with the service provider to purchase such services. By using one or more services, the customer irrevocably declares his / her consent to the application of these terms and conditions.

 

With regard to entrepreneurs, these terms and conditions also apply to future business relationships without our having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly consented to this.

 

2. Contractual partner, conclusion of contract

For the implementation of all consultations, individual and group trainings, workshops, events, private and business services, as well as retreats in Germany and abroad, the following general terms and conditions apply as agreed. At the latest with the binding booking, these terms and conditions are considered legally binding and accepted and accepted by the customer.


Changes to these general terms and conditions are fundamentally excluded and, in the case of deviating special agreements, are only effective if these have been agreed in writing.

Any changes to the terms and conditions agreed in this way are only valid for the respective legal transaction, expressly not for subsequent business or new bookings after the end of a service.

 

3. Contract language, contract text storage
The language available for the conclusion of the contract is German.

 

4. Payment terms

Prepayment by bank payment or twint or before the start of a meeting on the day of the appointment in cash or by twint.

 

Bookings for all offers are binding when they are sent, including bookings on all channels, such as online reservations, SMS, e-mail, social media and by post. In the case of registrations by telephone, these are confirmed by email; once the customer receives the confirmation email, these registrations are also legally binding and can be invoiced.

 

5. Dates - Cancellations - Refunds

Bookings that have been made once can be canceled by telephone or email no later than 48 hours before the start of the appointment.

In the case of late cancellations and no-shows, the consultation will be charged.

 

5.1 Workshops or retreats
If the participant is unable to participate in workshops or retreats, he / she always has the opportunity to find a replacement. This by written notification by email stating the surname / first name and email address of the substitute person.

 

Cancellations are associated with administrative work. Alternatively, the course fee can be partially waived depending on the cancellation date. Cancellations must be communicated in writing.

The waiver or reimbursement of course fees is regulated as follows:

Deregistration time refund
up to 2 months before the start of the event: 75% of the course fee
up to 11 days before the start of the event: 50% of the course fee
less than 11 days before the start of the event: 0% of the course fee

 

If the workshop or retreat is absent or canceled, there is no entitlement to a reduction or repayment.

 

 

5.2 Failure of the service provider
The service provider reserves the right to cancel at short notice in the event of illness or unforeseeable hindrance. The customer will be informed as soon as possible by email or phone.

 

5.3 Minimum / maximum occupancy for group courses or workshops, retreats, etc.
In order to be able to conduct courses under optimal conditions, a minimum and a maximum number of participants is determined depending on the event / course. If the number of participants is insufficient, it is possible that a retreat will not be held and the costs will be reimbursed.

 

6. Discounts
Students and the unemployed receive a 10% discount on bookings of 10 or more sessions upon presentation of a valid, recognized ID / RAV confirmation. The discount cannot be combined with other promotions or discounts.

 

7. Eligibility
Before participating in yoga lessons, mental coaching and massage therapies carried out by B-YOUnique, each participant must fill out an online registration or a registration form. By accepting the terms and conditions, the participant confirms that the participation in the booked service does not conflict with any health concerns. In every meditation practice, private or group yoga, massage treatment, as well as in events, workshops and retreats, self-responsibility and normal psychological and physical resilience and stamina are required. In the case of acute physical or psychological problems, a doctor should always be consulted first and the findings should be presented and discussed with the service provider in any case before any treatment. The same applies in the event of pregnancy. The service provider must be informed immediately if there is a health problem in the course of a treatment / course / workshop / retreat or if pregnancy occurs in the case of treatments / courses lasting several days.

Every participant participates independently in the booked services, so that it is also at the discretion of the respective participant to seek medical advice before participating in the treatments / courses / events / workshops. If a course participant has any doubts about their health or mental fitness to participate, it is recommended that they seek appropriate expert advice before registering or that this should be clearly addressed at the first session.

 

8. Liability
The service provider assumes liability for the proper implementation of the consultations / treatments / courses / events / workshops within the framework of the statutory warranty provisions. Any further liability, in particular under the heading of compensation, is expressly excluded. The service provider therefore assumes no liability whatsoever, in particular no liability whatsoever in the event of the concealment of any physical or mental ailments that make participation in the booked services appear inadvisable.

The service provider reserves the right to refuse customers if it is of the opinion that the health or psychological requirements are not met. This rejection can also be made at short notice or during ongoing courses / meetings / events. In the event of a refusal, the customer will be granted a (partial) reimbursement of the costs.

 

8.1
Customers use the premises and offers at their own risk. No liability is accepted for valuables brought along.

 

8.2
Any liability for damage incurred is excluded for all courses, events and retreats organized by B-YOUnique. You are therefore responsible for adequate insurance coverage yourself. B-YOUnique or Belinda Kakanou cannot be held liable for theft or loss of objects.

 

8.3

The author assumes no liability for the correctness, accuracy, timeliness, reliability and completeness of the information.

Liability claims against the author due to material or immaterial damage resulting from access to, use or non-use of the published information, from misuse of the connection or from technical malfunctions are excluded.

All offers are non-binding. The author expressly reserves the right to change, add to, or delete parts of the pages or the entire offer or to temporarily or permanently cease publication without prior notice.

 

8.4

References and links to third party websites are outside our area of ​​responsibility. We reject any responsibility for such websites. Access to and use of such websites is at the user's own risk.


9. Place of performance, place of jurisdiction, applicable law


9.1

The place of fulfillment of all obligations is the seat of B-YOUnique and the place of residence of Belinda Kakanou. The place of performance is therefore Zurich, ZH, Switzerland.

 

9.2
Swiss law applies; a Zurich arbitration board will be consulted in the first instance for any disputes. Any further discrepancies that cannot be resolved with the arbitration board will be directed to the responsible Zurich court.

 

9.3
Should individual partial provisions of these general terms and conditions, as well as any individual contracts to be concluded, be or become void, ineffective or contestable, the remaining (partial) provisions remain unaffected and must then be interpreted or supplemented in such a way that the intended economic purpose is as precisely as possible from a legal point of view is retained.

 

10. Images

B-YOUnique only uses photos of events on the website or social media, on which possible participants can be recognized. If this happens against the will of a person, he / she can order B-YOUnique to remove his / her person from the picture at any time.

 

11. Copyright

The copyrights and all other rights to content, images, videos or other files on this website belong exclusively to Belinda Kakanou (B-YOUnique) or the specifically named rights holders. The written consent of the copyright holder must be obtained in advance for the reproduction of any elements. Otherwise, imitations of any kind represent a violation of copyright law and will be prosecuted and oblige you to pay damages.

 

Insofar as the content on this site was not created by the operator, the copyrights of third parties are observed.
